I. GENERAL PROVISIONS
1. These General Terms and Conditions of Seniors Group AG, Tessinerplatz 7, 8004 Zurich, Switzerland (hereinafter «SENIORS GROUP») govern, on the one hand, the rights and obligations of customers (hereinafter «CUSTOMERS») who have their data entered on the SENIORS GROUP platform and offer their services via the SENIORS GROUP internet platform «www.seniorsatwork.ch» (incl. all subdomains).
On the other hand, these terms govern the rights and obligations of clients (hereinafter «CLIENTS») of the SENIORS GROUP internet platform «www.seniorsatwork.ch» (incl. all subdomains) who use the services of the CUSTOMERS.
2. A contract between the CUSTOMER/CLIENT and SENIORS GROUP is concluded upon completion of a senior profile or publication of an assignment for seniors on the internet platform «www.seniorsatwork.ch». These terms form an integral part of all contracts between the CUSTOMER/CLIENT and SENIORS GROUP. Payments, remuneration, service and warranty obligations, insurance, etc. relating to an assignment are a matter for the parties.
3. SENIORS GROUP reserves the right to amend these terms at any time without stating reasons. The amended terms will be sent by e-mail to registered CUSTOMERS and CLIENTS no later than two weeks before they take effect. If a CUSTOMER or CLIENT does not object to the new terms within two weeks of receiving the e-mail, the amended terms are deemed accepted. SENIORS GROUP will specifically point out the significance of this two-week period in the e-mail containing the amended terms.
4. The CUSTOMER accepts these terms when registering online by ticking the checkbox («opt-in function»). The CLIENT accepts these terms by publishing an assignment.
II. SERVICES OF SENIORS GROUP
5. SENIORS GROUP provides a platform on which CUSTOMERS can enter their name, age, profile picture, language, offer/services, etc. themselves via a personal free account. The scope of the profile and possible entries depends on the CUSTOMER's account. In addition to the basic settings, SENIORS GROUP may offer the CUSTOMER further services (additional memberships). Through the internet platform seniors@work, CUSTOMERS can present their offer/services to other internet users and interested persons or organisations and get in touch with interested parties.
6. Furthermore, CLIENTS can publish targeted assignments to find contractors or CUSTOMERS.
7. A service contract between the CUSTOMER and the interested CLIENT is negotiated and concluded solely between these two parties. SENIORS GROUP acts neither as a recruitment agency nor does it hire out its own staff.
8. Entries in the directory are sorted by publication date, distance to the address entered by the internet user, or a random pattern. SENIORS GROUP reserves the right to change these rules at any time.
9. The CUSTOMER and the CLIENT are responsible for keeping the access data to their account secret and not making it available to third parties. If access data is lost or disclosed to third parties, the customer or client shall inform SENIORS GROUP immediately, which will block the access data and send the CUSTOMER or CLIENT new access data for their account.
10. SENIORS GROUP expressly reserves the right to change, supplement, delete or discontinue parts or all of the website without notice.
10a. Usage quotas of the AI modules: The AI-supported modules (e.g. CV Booster, cover letter, Interview Coach, LinkedIn Coach) cannot be used without limit. A usage quota applies per module and billing period (e.g. number of documents created, analyses or runs). The scope of each quota is stated in the module's service description before purchase and can be viewed at any time in the CUSTOMER's account. Unused quotas expire at the end of the term and are neither carried over to a following period nor refunded. Once the quota is exhausted, the relevant function may be restricted until the start of the next period. SENIORS GROUP may adjust quotas for future billing periods; current, already paid periods remain unaffected. In case of abusive or automated use, SENIORS GROUP reserves the right to temporarily block access to the affected functions.
III. OBLIGATIONS OF THE CUSTOMER & CLIENT
11. The offer to create a profile on the platform is exclusively for customers aged at least 50. The CUSTOMER shall respect this. The CUSTOMER acknowledges and agrees that the internet platform is financed, among other things, by advertising revenue and that advertising is published on the internet platform for this purpose.
12. CUSTOMERS can choose between memberships with a term of 3 or 6 months. The services included and the applicable fees are based on the current SENIORS GROUP fee model, which is published on the website and forms an integral part of these terms. Memberships are not renewed automatically.
For CLIENTS, the service packages and prices published on the website apply.
13. The CUSTOMER and the CLIENT undertake not to make any unlawful or immoral entries in their account, assignment or in messages via the contact form, nor to offer or seek unlawful or immoral services (e.g. no untrue statements, no racist, discriminatory, pornographic, violence-glorifying or other content violating mandatory law, no violation of the privacy of others, no incitement to unlawful acts, etc.). Furthermore, both the CUSTOMER and the CLIENT are solely responsible for the content of their profile, offer, assignment or message, in particular regarding the truthfulness of their statements and questions of company, trademark, competition and personality rights. SENIORS GROUP is not obliged to check the content of entries.
14. SENIORS GROUP may reject, correct or immediately remove from the internet platform any profiles, offers, assignments and messages that are incorrect or misleading, contrary to public interests, serve an unlawful purpose or, in the opinion of SENIORS GROUP, are immoral or defamatory or could hurt the feelings and well-being of other CUSTOMERS and CLIENTS.
15. The CUSTOMER and the CLIENT are prohibited from offering or requesting goods of any kind on the platform, placing advertising for services or offers of third parties, or placing direct or indirect links to such services or offers. It is also not permitted to collect the data available on the internet platform and use it for purposes that do not correspond to the purpose of the SENIORS GROUP internet platform or are contrary to the interests of SENIORS GROUP.
16. The CUSTOMER/CLIENT is responsible for ensuring that any (social) insurance contributions, taxes and duties arising from their activities are correctly settled. Any accident and liability insurance relating to the activities/services of the CUSTOMER and CLIENT is also the responsibility of the CUSTOMER/CLIENT.
17. If the CUSTOMER or CLIENT breaches the above obligations, SENIORS GROUP expressly reserves the right to deactivate the account immediately or delete the assignment.
IV. LIABILITY OF SENIORS GROUP
18. To the extent permitted by law, any liability of SENIORS GROUP is excluded. In particular, SENIORS GROUP is not liable for profiles, offers and assignments created by CUSTOMERS and CLIENTS or for messages sent via the contact form. In the event of incorrectly transmitted profiles, offers, assignments or messages via the contact form, SENIORS GROUP is only liable for proven damage and only if the CUSTOMER or CLIENT proves that SENIORS GROUP caused the damage intentionally or through gross negligence. Furthermore, SENIORS GROUP accepts no liability for services undertaken and provided by CUSTOMERS.
19. Liability is also excluded for lost revenue of CUSTOMERS and CLIENTS, internet failures, misuse by third parties and loss of data on the CUSTOMER's information system or directory.
20. SENIORS GROUP is generally not liable for technical problems. In particular, SENIORS GROUP is not liable for temporary unavailability of the website/internet platform, the failure of individual or all functions, or malfunctions.
V. TERMINATION OF THE CONTRACT
21. The contract between the CUSTOMER/CLIENT and SENIORS GROUP is concluded for a fixed term and does not require termination.
22. Paid offers for the CUSTOMER/CLIENT are concluded for the minimum term according to the described duration of the package (1, 3 or 6 months) and end without notice at the end of this period. SENIORS GROUP informs the CUSTOMER before the end of the period about the end of the contract and gives them the opportunity to extend the membership.
23. The paid publication of an assignment ends at the end of the publication period for that assignment.
24. For good cause – in particular in case of misuse of the platform or breach of obligations by the CUSTOMER/CLIENT – SENIORS GROUP may terminate the contract at any time without notice.
25. If the CUSTOMER or CLIENT wishes to delete their account, they can send an e-mail with the subject “Delete account” to info@seniorsatwork.ch. SENIORS GROUP will then delete all account-specific data.
VI. DATA PROTECTION
26. All information and rules regarding use by SENIORS GROUP are governed by the SENIORS GROUP privacy policy.
VII. INTELLECTUAL PROPERTY
27. The copyright and all other rights to content, images, photos or other files on the website belong exclusively to SENIORS GROUP or the specifically named rights holders. The written consent of the copyright holders must be obtained in advance for the reproduction of any elements.
28. References and links to third-party websites are outside our area of responsibility. Any responsibility for such websites is rejected. Access to and use of such websites is at the user's own risk.
29. The CUSTOMER and the CLIENT undertake not to unlawfully use any copyrights or other intellectual property of third parties on the SENIORS GROUP platform. The CUSTOMER and the CLIENT thereby confirm that they will indemnify SENIORS GROUP against any third-party claims arising from such unlawful use of third-party intellectual property on the platform.
VIII. FINAL PROVISIONS
30. Should individual provisions of these terms be wholly or partially void and/or ineffective, the validity and/or effectiveness of the remaining provisions or parts thereof shall remain unaffected. The invalid and/or ineffective provisions shall be replaced by provisions that come economically closest to their meaning and purpose in a legally effective manner. The same applies to any gaps in the provisions.
31. All disputes in connection with the contractual relationship between SENIORS GROUP and a (current or former) CUSTOMER/CLIENT are governed exclusively by Swiss law. Place of performance and jurisdiction is the registered office of SENIORS GROUP, Zurich, Switzerland. For actions against a job seeker, the court at the job seeker's place of residence has jurisdiction.
